Elections delay case: Larger bench breaks down as Justice Aminuddin refuses to hear

Justice Aminuddin, who was part of the five-member bench of the Supreme Court, refused to hear the case of postponement of elections in two provinces on Thursday, after which the larger bench of the court broke down.

The Supreme Court was scheduled to continue hearing the Pakistan Tehreek-e-(PTI) Insaf’s appeal against the ECP’s decision to postpone the elections in Punjab and Khyber Pakhtunkhwa. But, the hearing was postponed due to Justice Aminuddin’s recusal.

When a five-member larger bench of the Supreme Court came for a hearing, the Chief Justice of Pakistan said that Justice Aminuddin Khan wanted to say something.

Justice Amin refused to hear the case in the context of yesterday’s decision.

Justice Amin said, “In the context of justice Qazi Faiz Isa’s decision, I apologize for hearing the case.”

After Justice Amin apologized, the larger bench of the court was dissolved and now a new bench will be formed in the case.

Yesterday, the Supreme Court ordered the postponement of all cases of Article 184-III (suo motu) until the rules were framed.

A three-member bench headed by Justice Qazi Faez Isa issued the verdict in the supreme court.

The special bench comprising Justice Aminuddin and Justice Shahid Waheed passed the order in a ratio of two to one.
