IHC accepts Federal and election commission’s intra-court appeals

Islamabad High Court has accepted federal and election commission intra-court appeals for hearing in Islamabad local body election case.

A two-member bench of the Islamabad High Court headed by Chief Justice Amir Farooq heard the intra-court appeals against the court’s decision to hold local body elections on December 31.

On behalf of the Election Commission, Mian Abdul Rauf Advocate appeared in the court and argued that the decision of the court was not taken into consideration by the single bench.

Rauf said that on December 27, the Election Commission ordered the postponement of the elections of December 31.

He further added that the Election Commission also gave reasons for the order to postpone the local body elections on December 31 but the single bench did not take these reasons into account.

DG Law Election Commission told the court that on December 28, Election Commission decided to postpone the elections, whereas the lawyer of the Election commission argued that the decision of the Election Commission of December 28 is final.

He also added that the bill to amend the Act had been passed by the National Assembly and Senate, whereas, the President did not sign it and sent it back.

Chief Justice Aamer Farooq while talking to the lawyer of the Election Commission said that the election could not have been postponed based on a bill, I keep this case for tomorrow or the day after tomorrow.

IHC also issued notifications to the Federal and Election commission of 9 January accepting the intra-court appeal for hearing.
