‘Can’t go further’, Audio Leaks Judicial Commission stops proceedings

The judicial commission formed on the alleged audio leaks stopped the proceedings and said, “We cannot go any further.” ‘

A three-member judicial commission headed by Justice Qazi Faez Isa of the Supreme Court conducted the hearing on Saturday.

Attorney General Mansoor Usman appeared before the commission and read out the stay order of a five-member bench of the Supreme Court.

The second meeting of the three-member inquiry commission headed by Justice Qazi Faez Isa, the senior-most judge of the Supreme Court, was held to investigate the alleged audio leaks related to the judiciary and judges by the federal government.

Yesterday, the Supreme Court suspended the notification of the commission formed to investigate the Audio Leaks Commission and issued notices to the Attorney General and other parties for the next hearing on May 31.

The commission of inquiry has held a hearing on the audio leaks issue, the commission had summoned four people involved in the audios.

A three-member commission headed by Justice Qazi Faez Isa is underway, chief justices of the Islamabad High Court and Balochistan High Court Amir Farooq and Naeem are part of the Afghan commission.

During the meeting, Justice Qazi Faez Isa said, “Attorney General, I think there has been a court order, do you have a copy of the court order?”

The Attorney General provided a copy of the Supreme Court order to the commission and read out the court order yesterday.

Justice Qazi Faez Isa remarked that the inquiry commission did not have a notice before the hearing, so how did it stop the work, according to the Supreme Court rules, after hearing the parties, an order is issued after hearing it.

Justice Qazi Faez asked the Attorney General why you were in the court room yesterday, had a notice or were sitting like that, I was verbally told that you should appear in the court, after the hearing, I was issued a notice.

Justice Qazi Faez Isa said that a copy of the court order should be provided, I also know a little bit in the constitution, you told the court yesterday why we have already explained the points of their objections.

Justice Qazi Faez Isa said that without knowing the authenticity of the audio, should someone’s life be destroyed, who recorded the audio is a later matter.

Justice Qazi Faez Isa said that according to the Supreme Court rules, the parties have to issue notices in advance, no petitioner has sent notice to the commission, the rules of the Supreme Court must be implemented.

He said that the government gave me a task, so we should sit, read the oath of judges, we are subject to the constitution and law.

While stopping the proceedings on this occasion, the head of the Audio Leaks Commission said that we can not proceed further, we are not proceeding further of the commission, we are grateful to the witnesses, we cannot proceed with the proceedings, the Attorney General we apologize, the Supreme Court is a judicial order of the Court, so we cannot continue further work.

Justice Qazi Faez Isa said that he would issue a written order of today’s proceedings, after which the Audio Leaks Inquiry Commission started writing the order.

It should be noted that in the written order of the hearing held in the Supreme Court yesterday, it was said that the objection raised by the government to the bench is rejected, it is a settled principle that permission from the Chief Justice of Pakistan is necessary for the inclusion of a judge in any inquiry commission.

“Prima facie, the federal government has violated the constitutional principle by taking unilateral action,” the order said.

A five-member bench headed by Chief Justice Mian Saqib Nisar said in a written order that the next hearing will be held on May 31 and issued notices to Attorney General Mansoor Usman Awan and other parties.
