Harvey Weinstein will be retried in New York after rape conviction overturned

The Manhattan District Attorney’s Office announced in court on Wednesday that former Hollywood producer Harvey Weinstein will face retrial in New York, following the overturning of his 2020 rape conviction by the state’s highest court.

Weinstein, 72, appeared in court before Judge Curtis Farber, nearly four years after his conviction, which had been hailed as a victory for the #MeToo movement.

Prosecutor Nicole Blumberg stated, “There was nothing consensual about this conduct,” indicating their intention to retry the case.

Weinstein, previously serving a 23-year sentence, was transferred to Bellevue Hospital following last week’s order.

Judge Farber remanded him back into custody, scheduling a new trial after Labor Day but not setting a firm date.

Weinstein, silent during the hearing, was represented by attorney Arthur Aidala, who expressed relief at returning to court, asserting confidence in a verdict of ‘not guilty’ if retried.

Weinstein is accused by over 80 women of sexual misconduct.

The New York Court of Appeals found Judge James Burke’s error in allowing testimony about Weinstein’s alleged prior sexual assaults, violating his right to a fair trial.

Weinstein also faces a separate 16-year sentence in California for rape.

Weinstein, known for co-founding Miramax, which produced hit films like ‘Shakespeare in Love’, has seen his eponymous film studio file for bankruptcy in 2018.
