SC seeks ulema opinion in Ahmedi citizen’s bail case

During the review petitions on Mubarak Ahmed’s bail decision, the Supreme Court asked all the petitioning scholars to deliver written comments within 2 weeks.

Chief Justice Qazi Faez Isa said that if the court has made a mistake in its decision, it will correct it as it is better to take a proper approach than to raise sticks and riot. He said it is a matter of Shariah, and the judges want to proceed with consideration. He said legal opinion will not be taken from scholars, as the knowledge of scholars in Shariat is more than us, we will take guidance from it. He asked what is the definition of a Muslim in Islam.
The court said that scholars should limit their opinions to the points raised in the court decision. Comments received after the specified time will not be counted. In civil cases, concerned persons can be made parties. In criminal cases, the parties can only be the plaintiff, the accused and the government. The opinions of all scholars will be heard without taking sides. Further hearing will be held after getting the opinion of the scholars
