Allegations of interference in judiciary

This does not happen every day that six honourable judges of a high court put a united front against intelligence agencies’ interference in their judicial work, given the reality that our part of the world is rife with intelligence agencies’ intervention in every affair of the government.  Six judges from the Islamabad High Court (IHC) have made history with their letter, addressed to the Supreme Judicial Council (SJC), accuses the country’s intelligence apparatus of blatant interference in judicial affairs. This raises serious concerns about the independence of the judiciary, a cornerstone of any democracy.

The allegations are nothing short of chilling. The judges detail incidents of intimidation, including secret surveillance and the abduction and torture of relatives. This paints a disturbing picture of a judiciary under undue pressure, unable to function freely. The letter further highlights the lack of clear guidelines for judges facing such situations, leaving them vulnerable and unsure of how to proceed.

The response has been swift and decisive. Calls for a probe have echoed from bar associations across the country, including the Supreme Court Bar Association and the Islamabad High Court Bar Association. These legal bodies understand the gravity of the situation and are demanding a thorough investigation.

The situation demands a multifaceted response. First, a transparent and impartial inquiry must be conducted. This inquiry should not only investigate the specific allegations raised by the judges but also examine any systemic issues enabling such interference. Legal action must be taken against those found responsible to ensure accountability and deter future transgressions.

Second, the judiciary needs to establish clear guidelines on how judges should report and respond to instances of attempted influence. This will empower judges and safeguard the integrity of the system.

Third, the treatment of journalists investigating these allegations needs to be addressed. A free press is crucial for exposing wrongdoing and holding institutions accountable. Cracking down on journalists stifles transparency and undermines the fight for a just system.

Finally, the courage of the six IHC judges who spoke out deserves immense praise. Their actions highlight the importance of judicial independence and serve as a beacon for others to follow.

The ball now lies in the court of the Supreme Judicial Council. Their response will be closely watched, not just in Pakistan, but around the world.
