Before marriage, bride has complete freedom to express consent

Islamabad: The Supreme Court has stated that the bride has complete freedom to express consent before finalizing the conditions and terms in the marriage contract.

A two-member bench comprising Justice Aminuddin Khan and Justice Athar Manullah issued a detailed ten-page verdict, written by Justice Athr Manullah.

The verdict stated that if there is any ambiguity or doubt in the conditions and terms of the marriage contract or in any entry or column, it will benefit the wife. If anyone fills in the columns of the marriage contract without the meaningful consultation of the bride, it cannot be used against the bride.

Furthermore, the verdict stated that it is established law that in case of any ambiguity, it should be interpreted in accordance with the actual intentions of the parties. Courts should consider whether the bride had complete freedom to express consent before finalizing the conditions and terms.

The verdict emphasized that any ambiguity cannot be exploited against the wife until a balance of resources is examined according to this principle.
