The discussion took place during a significant meeting at the Supreme Court, attended by Federal Minister for Law Azam Nazeer Tarar and Attorney General for Pakistan Mansoor Usman Awan. The meeting was prompted by recent revelations from six judges of the Islamabad High Court regarding alleged interference from intelligence agencies in judicial proceedings, sparking concerns about judicial integrity.
Responding promptly to the situation, Chief Justice Isa initiated high-level consultations, culminating in a meeting with the Prime Minister. A subsequent press release outlined the deliberations aimed at addressing the concerns raised by the judges.
During the meeting, Chief Justice Isa underscored the crucial role of an independent judiciary in upholding the rule of law and democracy. He emphasized that any executive intervention in judicial affairs would not be accepted, emphasizing the vital importance of judicial autonomy.
A proposal was put forward to establish an inquiry commission under the Pakistan Commissions of Inquiry Act, 2017, to investigate the allegations of interference. This commission, to be led by a retired judge of impeccable integrity, aims to unravel the complexities surrounding the issue and protect judicial independence.
Prime Minister Shehbaz Sharif expressed full support for the initiative, committing to convene a federal cabinet meeting to seek approval for the commission’s establishment. He echoed Chief Justice Isa’s sentiments, affirming his dedication to maintaining an independent judiciary and taking necessary steps to safeguard its autonomy.
Following the meeting, Chief Justice Isa briefed the judges on the developments during a full court session. The swift actions taken by both the judiciary and the executive underscore the seriousness with which the issue of judicial independence is being addressed.
In response to the revelations, bar associations across the country rallied behind the judges, expressing concern over perceived threats to judicial independence.
