LHC rules marriage to ex-wife’s sister within nine days of divorce Is illegal

The Lahore High Court has made a significant ruling, declaring it illegal to marry the sister of an ex-wife within just nine days of divorce.

Justice Tariq Saleem Sheikh delivered an 11-page written judgment, outlining the legal and religious perspective on this issue.

The ruling explains that marrying the sister of a former wife before her iddat period is completed is equivalent to marrying two sisters at once, which Islamic law prohibits. The court clarified that one cannot be married to two sisters at the same time.

Under the court’s decision, marriages under these conditions are considered invalid. The judgment instructs the husband and wife to separate immediately after learning the marriage is nullified. If they do not, the cleric who performed the marriage must end it.

The case involved Musawwir Hussain, who married his former wife’s sister nine days after their divorce. The court also revoked the interim bail for the suspect who married without observing the iddat period.
