In a major political and judicial development, Pakistan Peoples Party (PPP) Chairman Bilawal Bhutto Zardari and Prime Minister’s Advisor on Political Affairs Senator Rana Sanaullah Khan have been formally appointed as members of the Judicial Commission of Pakistan (JCP).
The official notification for their appointment has been issued following final approval from Chief Justice of Pakistan and Chairman of the Judicial Commission, Justice Yahya Afridi.
*Vacancies That Led to New Appointments*
The appointments come after two members representing the treasury benches resigned from the commission, leaving two crucial seats vacant.
1. *Farooq H. Naek (PPP):* The senior PPP leader and former Senate member resigned from his position as a JCP member from the Senate. He cited personal engagements as the reason for his resignation and formally informed Senate Chairman Yousaf Raza Gillani and Deputy Prime Minister Ishaq Dar through a letter.
2. *Sheikh Aftab Ahmed (PML-N):* The Pakistan Muslim League (N) leader also resigned from his position as a JCP member representing the National Assembly.
*Revised Government Representation*
Following the resignations, the ruling alliance held mutual consultations to decide on new representation.
Prime Minister Shehbaz Sharif, as Leader of the House, finalized the nominations:
– *From National Assembly:* Bilawal Bhutto Zardari has been nominated in place of Sheikh Aftab Ahmed (PML-N).
– *From Senate:* Senator Rana Sanaullah has been nominated in place of Farooq H. Naek (PPP). This represents an interesting cross-party adjustment where the PPP Chairman takes the National Assembly slot previously held by PML-N, while the PML-N stalwart Rana Sanaullah takes the Senate slot previously held by PPP.
*Constitutional and Legal Framework*
The appointments have been made under Article 175A(2)(vii) of the Constitution of Pakistan.
Under this clause, the Judicial Commission of Pakistan includes one member from the National Assembly and one from the Senate, nominated by the respective Leaders of the House. Their names were formally recommended under this constitutional provision and subsequently approved by the Chairman of the Commission.
*Background: What is the JCP and Why It Matters*
The Judicial Commission of Pakistan was restructured following the 26th Constitutional Amendment. It is the apex body responsible for:
– Appointment of judges to the Supreme Court of Pakistan, the Federal Constitutional Court, and all four provincial High Courts.
– Reviewing judicial reforms and considering matters related to the performance and accountability of the judiciary.
– The Commission is headed by the Chief Justice of Pakistan and includes senior Supreme Court judges, the Attorney General, Federal Law Minister, representatives of the Bar Councils, and parliamentary members.
The inclusion of two of the most prominent figures of the ruling coalition – the hetead of PPP and the chief political advisor to the Prime Minisr – is being viewed as politically significant. Analysts believe their presence will strengthen the government’s political representation in the crucial process of judicial appointments at a time when the judiciary is at the center of major constitutional and political developments in the country.
