The Lahore High Court (LHC) has ruled that courts cannot allow plaintiffs to withdraw civil cases and file fresh suits without providing clear and detailed reasons.
The court held that permission to initiate a new suit after withdrawal must be supported by a proper, reasoned order explaining the legal grounds behind the decision.
Justice Raheel Kamran issued the ruling while hearing a constitutional petition challenging decisions of a civil court and the additional district judge in Wazirabad.
The case involved a plaintiff, Muhammad Arshad, who had filed a suit seeking declaration, possession and a permanent injunction against the petitioner and another party.
During the trial, after the framing of issues and when the case reached the evidence stage, the plaintiff requested permission to withdraw the case and file a fresh one.
He claimed that the original suit contained legal flaws and that the plaint had been prepared on incorrect facts.
The trial court accepted the request and allowed the withdrawal of the suit with permission to file a new case. It also imposed a cost of Rs3,000 on the plaintiff.
The decision was later upheld by the revisional court.
However, the matter was challenged before the Lahore High Court, where the petitioner’s lawyer argued that the plaintiff had failed to identify any specific legal defect or valid reason required under Order XXIII Rule 1(2) of the Code of Civil Procedure (CPC).
The lawyer argued that the lower courts did not explain how the alleged defects could affect the outcome of the case or justify permission for a fresh lawsuit.
Justice Kamran observed that withdrawing a suit and allowing a new case are different legal matters. He said permission for a fresh suit removes the legal restriction on filing another case based on the same cause of action, therefore courts must carefully examine such requests.
The judge stated that courts must record reasons showing that a formal defect or other sufficient legal grounds exist before granting such permission.
He added that judicial satisfaction cannot remain only in the judge’s mind but must be clearly reflected in the written order.
The LHC noted that in the current case, the plaintiff only mentioned general legal defects and incorrect facts, while the lower courts failed to identify the exact issues or explain why they met legal requirements.
