Court documents reportedly show that Martinez sought a temporary restraining order against Berry following an alleged incident involving their son on September 26.
Martinez alleged that Berry physically attacked Maceo during the incident. His filing also claimed that there had been other alleged physical, verbal and emotional abuse involving the family in recent years. These allegations have not been established in court.
Martinez’s attorney said his client’s primary concern was the child’s safety and wellbeing. The lawyer described Martinez as a devoted father and said he took legal action out of concern for his son.
Berry’s legal team strongly rejected the allegations. Her attorney called Martinez’s filing misleading and without merit, saying Berry remains focused on Maceo’s welfare and will continue to provide him with support and care.
On October 1, a Los Angeles County judge granted Martinez a temporary restraining order following the allegations. The court also temporarily adjusted Berry’s visitation arrangements, while allowing her to maintain partial custody and contact with Maceo.
The judge did not grant Martinez’s request for monitored sobriety, citing insufficient information.
The latest court action marks another chapter in the former couple’s lengthy custody dispute. Further proceedings are expected to determine the next steps regarding custody and visitation arrangements.
