LHC CJ questions establishment Secretary’s absence in DIG promotion case

LAHORE: Lahore High Court (LHC) Chief Justice Aalia Neelam has expressed displeasure over the absence of the Federal Secretary Establishment during proceedings concerning the promotion of DIG Ahmed Naseer Aziz Waraich to the next grade.

The case relates to a challenge involving the officer’s promotion and a decision of the Federal Service Tribunal. During the hearing, Chief Justice Aalia Neelam questioned why the Secretary Establishment had not appeared before the court and sought an explanation for his absence.

Expressing concern over the non-appearance, the Chief Justice remarked, “This is not such a weak judicial system,” and questioned whether the Secretary was considered too important to appear before the court.

She further observed that there could hardly be a greater urgency than a matter being heard by the court.

The court was informed that the Secretary Establishment had challenged the Federal Service Tribunal’s decision. Chief Justice Aalia Neelam noted that the tribunal had allowed the applicant’s request concerning promotion.

The Lahore High Court subsequently directed that the affidavit of the officer who had recorded a statement before the Federal Service Tribunal be produced before the court within 10 days.

The proceedings will continue after the required affidavit and related material are submitted.

The court’s observations came amid scrutiny of the administrative and legal proceedings surrounding the promotion of DIG Ahmed Naseer Aziz Waraich.
